Amendments to National Instrument 94-101 Mandatory Central Counterparty Clearing of Derivatives and Changes to Companion Policy 94-101 Mandatory Central Counterparty Clearing of Derivatives

On September 1, 2022, amendments (the Rule Amendments) to National Instrument 94-101 Mandatory Central Counterparty Clearing of Derivatives (the Rule) and changes (the Policy Changes) to Companion Policy 94-101 Mandatory Central Counterparty Clearing of Derivatives (the Policy) will become effective under the Securities Act (°ÄÃÅÓÀÀû), with the exception of the amendments to Appendix A and B of the Rule, which became effective on April 12, 2022.

The purpose of the Rule Amendments is to refine the scope of the requirement for certain market participants to clear certain over-the-counter derivatives through a regulated clearing agency (the Clearing Requirements). The Rule Amendments will achieve this goal by limiting the Clearing Requirements to market participants that can feasibly access clearing services or that have derivatives exposure that represents a potential systemic risk.
