Amending O. Reg. 222/98

(GENERAL)

1. Clauses 27 (1) (a) and (b) of �������� Regulation 222/98 are revoked and the following substituted:

(a) $40,000;

(b) $10,000, if there is a spouse included in the benefit unit; and

2. (1) Paragraph 14 of subsection 28 (1) of the Regulation is amended by striking out “Subject to subsections (2) and (2.2)” at the beginning and substituting “Subject to subsection (2.2)”.

(2) Paragraph 14.1 of subsection 28 (1) of the Regulation is amended by striking out “Subject to subsection (2)” at the beginning.

(3) Paragraph 14.2 of subsection 28 (1) of the Regulation is amended by striking out “Subject to subsection (2)” at the beginning.

(4) Subsections 28 (2) and (2.1) of the Regulation are revoked.

3. (1) The Table to paragraph 1 of subsection 30 (1) of the Regulation is revoked and the following substituted:

For each additional dependant, add $207 if the dependant is 18 years of age or older or $0 if the dependant is 0 to 17 years of age.

(2) The Table to paragraph 2 of subsection 30 (1) of the Regulation is revoked and the following substituted:

(2) Paragraph 5 of subsection 31 (2) of the Regulation is amended by striking out “$68” and substituting “$70”.

5. (1) Paragraph 1 of subsection 32 (1) of the Regulation is amended by striking out “$143” at the beginning and substituting “$146”.

(2) Paragraph 2 of subsection 32 (1) of the Regulation is amended by striking out�� “$981” and substituting “$1,001”.

(3) Paragraph 3 of subsection 32 (1) of the Regulation is amended by striking out “$985” in the portion before subparagraph i and substituting “$1,005”.

6. (1) Subparagraph 1 i of subsection 33 (1) of the Regulation is amended by striking out “$796” at the beginning and substituting “$812”.

(2) Subparagraph 1 ii of subsection 33 (1) of the Regulation is amended by striking out “$1,187” at the beginning and substituting “$1,211”.

(3) Subparagraph 1 iii of subsection 33 (1) of the Regulation is amended by striking out “$1,587” at the beginning and substituting “$1,619”.

(4) Sub-subparagraph 2 i A of subsection 33 (1) of the Regulation is amended by striking out “$233” at the beginning and substituting “$238”.

(5) Sub-subparagraph 2 i B of subsection 33 (1) of the Regulation is amended by striking out “$268” at the beginning and substituting “$274”.

(11) Subparagraph 2.1 ii of subsection 33 (1) of the Regulation is amended by striking out “$132” at the beginning and substituting “$135”.

(12) Subparagraph 2.1 iii of subsection 33 (1) of the Regulation is amended by striking out “$218” at the beginning and substituting “$223”.

(13) The Table to paragraph 3 of subsection 33 (1) of the Regulation is revoked and the following substituted:

(14) Paragraph 5 of subsection 33 (1) of the Regulation is revoked and the following substituted:

7. (1) Subsection 33.1 (2) of the Regulation is amended by striking out “and” at the end of clause (g), by revoking clause (h) and by substituting the following:

(h) not less than the sum of $143 for each member of the benefit unit, with respect to determinations relating to a month after August 31, 2016 and before September 1, 2017; and

(i) not less than the sum of $146 for each member of the benefit unit, with respect to determinations relating to a month after August 31, 2017.

(2) Subsection 33.1 (3) of the Regulation is amended by striking out “$143” and substituting “$146”.

8. The Table to subparagraph 1 ii of section 40 of the Regulation is revoked and the following substituted:

For each additional dependant, add $207 if the dependant is 18 years of age or older or $0 if the dependant is 0 to 17 years of age.

The amount attributable to a dependent child shall be reduced by 50 per cent where budgetary requirements for the child were reduced under section 33.2.

9. Paragraph 13 of subsection 41 (1) of the Regulation is amended by striking out “Subject to subsections 43 (2) and (5)” at the beginning and substituting “Subject to subsection 43 (5)”.

10. (1) Paragraph 4 of subsection 43 (1) of the Regulation is amended by striking out “Subject to subsections (2), (3) and (5)” at the beginning and substituting “Subject to subsections (3) and (5)”.

(2) Paragraph 4.1 of subsection 43 (1) of the Regulation is amended by striking out “Subject to subsections (2) and (5)” at the beginning and substituting “Subject to subsection (5)”.

(3) Paragraph 13 of subsection 43 (1) of the Regulation is amended by striking out “$6,000” and substituting “10,000”.

(4) Subsection 43 (1) of the Regulation is amended by adding the following paragraph:

13.1 A gift or voluntary payment received for any of the following purposes, if the gift or payment is applied as soon as practicable for the purpose for which it was intended:

i. The purchase of a principal residence for the benefit unit.

ii. The purchase of a motor vehicle referred to in paragraph 6 or 7 of subsection 28 (1).

iii. To pay the first and last month’s rent necessary to secure accommodation for the benefit unit.

(5) Subsection 43 (2) of the Regulation is revoked.

11. Paragraph 5 of subsection 44 (1) of the Regulation is amended by striking out “$80” and substituting “$82”.

Commencement

12. (1) Subject to subsection (2), this Regulation comes into force on August 1, 2017.

(2) Sections 1, 3, 4, 5, 6, 7 and 8, subsections 10 (3) and (4) and section 11 come into force on September 1, 2017.
