General

Interpretation

1. In this Regulation,

“data standards” means the data standards established under section 6 of the Act entitled “Data Standards for the Identification and Monitoring of Systemic Racism” and approved by Order in Council 897/2018; (“normes relatives aux données”)

“specified children’s aid society” means a children’s aid society designated under the Child, Youth and Family Services Act, 2017 that is listed in Schedule 1 to this Regulation; (“société d’aide à l’enfance précisée”)

“young person” means a young person as defined in subsection 2 (1) of the Child, Youth and Family Services Act, 2017. (“adolescent”)

Authorization or requirement to collect information

2. (1) A public sector organization or a member of a class of public sector organizations set out in Column 1 of the Table to this section,

(a) is either authorized or required, as indicated opposite the organization or class of organizations in Column 2 of the Table, to collect the information, including personal information, set out opposite the organization or class of organizations in Column 3 of the Table in relation to the programs, services or functions set out opposite the organization or class of organizations in Column 4 of the Table; and

(b) shall, with respect to the information that is personal information, comply with all or part of the data standards, as indicated in Column 5 of the Table opposite the organization or class of organizations, unless it is indicated that none of the standards apply with respect to the information.

(2) The public sector organization or member of a class of public sector organizations is authorized or required to collect the information in relation to the programs, services or functions as of the date set out in Column 6 of the Table opposite the organization or class of organizations.

2. 4. 5.	Ministry of Community Safety and Correctional Services	Required	The Indigenous identity, race, religion and ethnic origin of a person who is in custody in a correctional institution operated by the ministry or a person who is released on parole, subject to a probation order or a conditional sentence order and subject to supervision by the ministry	Operation of adult correctional institutions and probation and parole offices	All	April 1, 2020
6.	Ministry of Community Safety and Correctional Services	Required	As provided by police forces, the race of individuals in respect of whom a use of force report is prepared by a member of the police force and any other information set out in the report, other than the name of the individual, that the police force is legally required to provide to the ministry	Conducting research and analysis to inform policy and program development, system planning and the evaluation of service delivery and outcomes in respect of policing and related matters	Not applicable	January 1, 2020
7. 8. 9.	Ministry of the Attorney General	Required	With respect to circumstances in which a person is seriously injured or dies and in which the injury or death may have resulted from criminal offences committed by a police officer, the Indigenous identity, race, religion and ethnic origin of the person and the officer	With respect to the functions of the Ministry’s special investigations unit, determining whether to conduct an investigation into the serious injury or death, and conducting any such investigation	All	April 1, 2020
10.	Specified children’s aid societies	Required	The Indigenous identity, race, religion and ethnic origin of children who are the subject of a child protection investigation conducted by a specified children’s aid society and children who otherwise receive a service from a specified children’s aid society	The functions of a children’s aid society set out in subsection 35 (1) of the Child, Youth and Family Services Act, 2017	All	July 1, 2021
11. Amendments to this Regulation

3. (1) Item 8 of the Table to section 2 of this Regulation is revoked and the following substituted:

Determining whether to conduct an investigation into the death or serious injury of a person, the discharge of a firearm at a person or the sexual assault of a person that may have resulted from the conduct of an official, and conducting any such investigation

Commencement

4. (1) Subject to subsections (2) to (4), this Regulation comes into force on the day it is filed.

(2) Subsection 3 (1) of this Regulation comes into force on the later of the day section 42 of Schedule 2 to the Safer �� Act, 2018 comes into force and the day this Regulation is filed.

(3) Subsection 3 (2) of this Regulation comes into force on the later of the day section 4 of Schedule 4 to the Safer �� Act, 2018 comes into force and the day this Regulation is filed.

(4) Subsection 3 (3) of this Regulation comes into force on the later of the day section 5 of Schedule 2 to the Safer �� Act, 2018 comes into force and the day this Regulation is filed.
