Amending Reg. 941 of R.R.O. 1990

(GENERAL)

1. The definition of “Professional Practice Examination” in section 1 of Regulation 941 of the Revised Regulations of ��������, 1990 is revoked and the following substituted:

“professional practice examination” means the examination in respect of professional ethics, engineering law and other related matters that is set or approved by the Council for the purposes of this Regulation; (“examen sur l’exercice de la profession”)

2. Clause 29 (f) of the Regulation is amended by striking out “the Canadian Council of Professional Engineers” and substituting “Engineers Canada”.

3. Subparagraph 1 ii of subsection 32.1 (2) of the Regulation is amended by striking out “subject to the Chapter’s by-laws” at the beginning.

4. (1) Subparagraph 1 i of subsection 33 (1) of the Regulation is amended by striking out “an engineering program from a Canadian university” and substituting “a Canadian engineering program”.

(2) The English version of paragraph 5 of subsection 33 (1) of the Regulation is amended by striking out “Professional Practice Examination” at the end and substituting “professional practice examination”.

5. (1) Subsection 36 (6) of the Regulation is amended by striking out “A thesis” at the beginning and substituting “An engineering report”.

(2) The English version of subsection 36 (6) of the Regulation is amended by striking out “Professional Practice Examination” and substituting “professional practice examination”.

6. Section 37 of the Regulation is revoked and the following substituted:

Professional practice examination

37. An applicant for a licence or limited licence must pass the professional practice examination not later than two years following the later of,

(a) the date on which the applicant submitted the application to the Registrar; and

(b) the date of successful completion of all other examination requirements, other than the writing of an engineering report, if required, or the final determination that no examination or engineering report is required.

7. (1) The English version of subsection 38 (1) of the Regulation is amended by striking out “Professional Practice Examination” and substituting “professional practice examination”.

(2) The English version of subsection 38 (3) of the Regulation is amended by striking out “The Professional Practice Examination” at the beginning and substituting “The professional practice examination”.

8. Subsection 44.1 (1) of the Regulation is amended by striking out “may grant” and substituting “shall issue”.

9. The English version of paragraph 3 of subsection 46 (1) of the Regulation is amended by striking out “Professional Practice Examination” at the end and substituting “professional practice examination”.

Commencement

10. (1) Subject to subsection (2), this Regulation comes into force on the later of December 7, 2020 and the day it is filed.

(2) Section 8 comes into force on the later of the day subsection 5 (24) of Schedule 2 to the Open for Business Act, 2010 comes into force and the day this Regulation is filed.
