Amending Reg. 194 of R.R.O. 1990

(RULES OF CIVIL PROCEDURE)

1. The definition of “court” in subrule 1.03 (1) of Regulation 194 of the Revised Regulations of ��������, 1990 is revoked and the following substituted:

“court” means the court in which a proceeding is pending and, in the case of a proceeding in the Superior Court of Justice, includes a case management master; (“tribunal”)

2. Rule 1.09 of the Regulation is amended by striking out “a judge, master or case management master” in the portion before clause (a) and substituting “a judge or case management master”.

3. Subparagraph 2 iii of subrule 4.05.3 (6) is revoked and the following substituted:

iii.�� the name of the party submitting the document, and

iv.�� the date on which the document was created or signed, in the format DD-MMM-YYYY (e.g. 12-JAN-2021).

4. Clause 62.01 (1) (a) of the Regulation is amended by striking out “master or”.

5. The English version of subrule 77.07 (3) of the Regulation is amended by striking out “jurisdiction of a master” and substituting “jurisdiction of a case management master”.

6. The rows for Forms 53D, 56A, 64B, 64E, 64G, 64H, 64I, 64J, 64K, 64L, 64M, 65A, 66A and 76B in the Table of Forms to the Regulation are amended by striking out the date in the column titled “Date of Form” and substituting “November 1, 2020”.

7. The following provisions of the Regulation are amended by striking out “master” wherever it appears and substituting in each case “case management master”:

1.�� Subrule 3.03 (2).

2.�� Rule 13.02.

3.�� Subrule 20.04 (4).

4.�� Subrule 37.02 (2).

5.�� Rule 37.04.

6.�� Subrules 37.05 (1) and (3).

7.�� Subrule 37.10 (1).

8.�� Subrules 37.14 (3) and (5)

9.�� Subrules 37.15 (1.1) and (1.2).

10.�� Rule 37.16.

11.�� Subrule 43.04 (3).

12.�� Subrule 54.04 (2).

13.�� Subrule 54.05 (1).

14.�� Subrule 60.08 (16).

15.�� Rule 64.02.

Commencement

8. (1) Subject to subsection (2), this Regulation comes into force on the later of January 1, 2021 and the day it is filed.

(2) Sections 1, 2 and 4 to 7 come into force on the later of January 8, 2021 and the day this Regulation is filed.
