Amending O. Reg. 539/21

(DESIGNATION AND EXEMPTION: REID ROAD RESERVOIR QUARRY)

1. The definition of “project” in section 1 of �������� Regulation 539/21 is amended by striking out “an undertaking to which the Act applies” and substituting “a project to which Part II.3 of the Act applies”.

2. Section 2 of the Regulation is amended by,

(a) striking out “is defined as a major commercial or business enterprise or activity and” in the portion before paragraph 1; and

(b) striking out “an undertaking to which the Act applies” in the portion before paragraph 1 and substituting “a project to which Part II.3 of the Act applies”.

3. Subsection 3 (1) of the Regulation is revoked and the following substituted:

Exemption

3. (1) The project is exempt from sections 17.3, 17.4 and 17.6 and subsections 17.11 (4) to (7) of the Act, from any other requirement of the Act respecting terms of reference, and from section 4 of �������� Regulation 53/24 (General and Transitional Matters) made under the Act, if the proponent complies with sections 4 to 12 of this Regulation.

4. (1) Subsection 11 (1) of the Regulation is amended by striking out “section 6.3” and substituting “section 17.8”.

(2) Subsection 11 (3) of the Regulation is amended by striking out “subsection 6.3 (1)” and substituting “subsection 17.8 (1)”.

5. Subsection 12 (1) of the Regulation is amended by striking out “section 7” and substituting “section 17.11”.

Commencement

6. This Regulation comes into force on the later of the day subsection 3 (2) of Schedule 6 to the COVID-19 Economic Recovery Act, 2020 comes into force and the day this Regulation is filed.
